Welcome to Molly. Please read the following Terms of Service carefully before using our software, features, or website (the "Platform") so that you are aware of your legal rights and obligations with respect to Philemon Ofotan / Molly ("Molly", "we", "our" or "us").

1. Background & General Terms

By accessing or using the Platform, you expressly acknowledge and agree that you are entering a legal agreement with us and have understood and agree to comply with our Terms. If you do not agree to be bound by these Terms please do not access or use the Platform. By using Molly, you will be able to submit prompts, images, video inputs, and other material ("Input") to generate output formats via our integrations ("Output").

2. Ability to Accept Terms

The Platform is only intended for individuals aged eighteen (18) years or older. If you are under 18 years please do not visit or use the Platform without the supervision or consent of a legal guardian. We reserve the right to suspend access to the Platform to any person in breach of this section.

3. Restrictions & Prohibited Use

You shall not: (i) copy, distribute or modify any part of the Platform beyond your personal licensed usage; (ii) reverse engineer, disassemble, decompile, or otherwise attempt to derive source code; (iii) circumvent, disable, or otherwise interfere with security-related features of the Platform; or (iv) input illegal content, abuse the systems, or use the Platform in violation of these Terms, applicable law, or third-party rights.

4. Your Content & Responsibility

4.1 Intellectual Property

As between the parties and to the extent permitted by applicable law, you own your Input. You are entirely responsible for the Output you generate and how you choose to broadcast, record, or distribute it. You represent and warrant that you own or have all the necessary rights and permissions to use the Input on our Platform.

4.2 Compliance

You are solely responsible for ensuring that your Content does not violate any applicable law, third-party rights, or encourage unethical, offensive, or abusive behavior.

5. Artificial Intelligence Disclaimers

Artificial intelligence and machine learning are rapidly evolving fields. Given the generative nature of AI, the use of our Platform may result in unintended outputs or unpredictable artifacts. You should evaluate the accuracy and appropriateness of any Output for your personal use case. To the maximum extent permitted by law, we shall not be responsible or held liable for the Output or your reliance on the Output.

6. Purchases, Subscriptions & Refunds

Molly requires a valid license key derived from a purchase to access the core software. Unless exceptionally mandated by applicable digital consumer laws, purchases or subscriptions executed on the Platform are non-refundable once the software key has been utilized or after the agreed-upon grace period.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, MOLLY (AND ITS CREATORS/AFFILIATES) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, EXEMPLARY, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS OR REPUTATION, ARISING UNDER THESE TERMS OR OUT OF YOUR USE OF THE PLATFORM.

8. Term and Termination

These Terms are effective until terminated by either party. We reserve the right to suspend your access to the service or revoke your license temporarily or indefinitely in the event of any breach. Upon termination, you shall cease all use of the Platform.

9. Governing Law

These Terms and the relationship between you and Molly shall be governed by and construed in accordance with standard international commerce regulations. Any disputes shall be resolved mutually and informally if possible before resulting in other venues.
